Preamble
The present General Terms and Conditions of Sale are concluded between, on the one hand,
SAS Dyades (hereinafter referred to as Dyades), a company with share capital of €40,000

and, on the other hand, any person wishing to place an order (hereinafter referred to as "Customers") via the "www.dyadesparis.com" website, the exclusive property of Dyades.

Article 1 - Purpose
Governed by article L. 441-6 of the French Commercial Code and in accordance with article L.111-1 of the French Consumer Code, these General Terms and Conditions of Sale govern the sale of all products presented on the www.dyadesparis.com website by the company Dyades. They aim to define the reciprocal obligations of the parties as well as the various stages of the order process.
By validating an order on the Site, the Customer declares that he/she has read, understood and accepted, without reservation, the terms of the said order, as well as the entirety of these General Terms and Conditions of Sale.
These conditions are subject to change. It is therefore understood that the applicable conditions are those in force on the site at the time of contracting.
Article 2 - Legal capacity
Customers declare that they are of legal age and fully capable of contracting.

Article 4 - Prices of products on sale
Unless otherwise stated, all prices include VAT and any customs duties.
Shipping and returns are free, unless otherwise indicated.
Dyades offers its customers payment in different currencies depending on the country of delivery. You can find this information in article 3.
If you are visiting the website from a country other than the country of delivery, the price and applicable currency will be updated on the payment page according to the delivery destination. You should carefully check the updated prices and applicable currency. Prices, taxes and delivery charges vary from country to country.
Dyades reserves the right to modify product prices at any time. Any rate change will be applied immediately to the current order.
Article 5 - Articles and products
Dyades strives to describe the products offered for sale as accurately as possible. Prior to placing an order, the Customer has the opportunity to familiarize himself/herself with the essential characteristics of the products he/she intends to purchase on the Dyades website. However, Dyades cannot be held liable for any errors in this presentation. Illustrations and photos of products supporting the text are not contractually binding.
Article 6 - Customized products
The seller sets up a personalized Products service for the customer.
With this service, customers can personalize the Product of their choice with the design, materials, color or engraving of their choice.
The Customer assures the Vendor that the texts to be engraved are free from infringement of third-party rights, in particular intellectual property rights of any kind, as well as personality rights or rights to a name.
The text to be engraved must not be abusive, nor violate the French law of July 29, 1881 governing freedom of expression.
Should the Customer transmit to the Vendor a motif and/or text infringing the rights of third parties, whatever they may be, or French law, responsibility will rest entirely with the Customer.
Dyades also reserves the right to refuse to engrave the text supplied.
It is expressly agreed that personalized Products may not be the subject of the right of withdrawal or return for exchange or refund provided for in articles 7, 9 and 10 of these General Terms and Conditions of Sale.
Article L.121-21-8 of the French Consumer Code states:
"The right of withdrawal cannot be exercised for contracts (...) for the supply of goods made to the consumer's specifications or clearly personalized".
Article 7 - Orders
From the moment the Customer definitively validates his/her order by clicking on "Validate your payment", it is established that he/she knowingly accepts the content, terms of delivery and conditions of the Order in question, and in particular the present General Terms and Conditions of Sale, the prices, quantities, descriptions, characteristics, volumes and delivery times of the products ordered by the Customer on the Site.
Dyades will acknowledge receipt of this order by sending an e-mail to the Customer who placed the order. Dyades reserves the right to cancel or put on hold the execution of an Order or its delivery, regardless of its nature or the stage of its execution, in the event of an inability to debit the Customer's bank account for the order or any sum due by the Customer, or if a payment incident occurs, or in the event of fraud or attempted fraud relating to the use of the Dyades Internet Site, including in the case of prior orders.
Finally, Dyades cannot be held liable if the e-mail address provided by the Customer at the time of registration is incorrect, and if the Customer has not received the Order confirmation e-mail sent systematically by Dyades. The sale will then be considered definitive, unless Dyades deliberately decides to cancel it. The Customer may, however, exercise his right of withdrawal (except in the case of personalized products) within 30 days of the date of the order.
At the time of ordering, the Customer may request billing to a name and address other than the delivery address. However, the delivery address will be used to calculate the product price, taxes and delivery charges.
Article 8 - Payment
The Customer can pay on the website :
- By credit card: Visa, Mastercard, American Express
- By Apple Pay
- Payment by bank deposit is also possible by following the instructions given at the time of ordering.
The invoice amount will be debited from the customer's account on the date of payment.
The Customer guarantees Dyades that he/she has the necessary authorizations to use the method of payment chosen by him/her when validating the order.
Article 9 - Delivery
- Delivery zones
The delivery service covers all the geographical zones defined in article 3.
- Terms of delivery
The products ordered will be delivered to the Customer at the delivery address given when the order was placed.
Dyades products are usually made to order, due to their high level of customization and to avoid over-consumption. Estimated delivery times are indicated when the order is placed, and may be specified by e-mail following analysis of component stocks.
In the event of delay, Dyades undertakes to notify the customer by e-mail as soon as possible. The customer may then choose to cancel the order and be reimbursed (except for personalized products) or keep the order.
Any parcel returned to Dyades because of an incorrect or incomplete delivery address will be reshipped at the Customer's expense.
If, at the time of delivery, the original packaging is damaged, torn or open, the Customer must check the condition of the items. If they have been damaged, the customer must refuse the parcel and note a reservation on the delivery note (parcel refused because opened or damaged).
The customer must notify Dyades on the day of delivery, or at the latest on the first working day following delivery, of any claim of error of delivery and/or non-conformity of the products in kind or in quality in relation to the indications on the order form. This claim should be sent to the following e-mail address: contact@dyadesparis.com.
Any claim not made in accordance with the above rules and within the specified time limits will not be taken into account and will release Dyades from any liability to the Customer.
Article 10 - Right of withdrawal, return and exchange
With the exception of personalized products, Dyades authorizes the Customer to retract and request the return or exchange of products for 30 days after receipt of the products. After this period, products cannot be refunded or exchanged.
To request a return or exchange, please contact customer service by sending an email to contact@dyadesparis.com.
To be eligible for a return or exchange, your item must be unused, complete (cases, accessories, etc.) and in the condition in which you received it. It must also be returned in its original packaging.
Returns are handled only once per order.
Refunds (if any)
Once your return has been received and inspected, we will send you an email to inform you that we have received your returned item. We'll also let you know if your refund has been approved or rejected.
If your refund is approved, it will be processed and a credit will be issued to your credit card or original payment method within a few days.
Late or missing refunds (where applicable)
If you have not yet received a refund, please check your bank account again first.
Then contact your credit card company. It may take some time before your refund is officially recorded.
Then contact your bank. There is often a processing time before the refund is posted.
If you have taken all these steps and still have not received your refund, please contact us at contact@dyadesparis.com.
Exchanges (if any)
You can exchange a product within 30 days of receipt. If the exchanged product is more expensive than the original order, an invoice with a payment link will be sent to you by email. As soon as we receive the missing amount, the new order will be validated and we will inform you of the delivery date.
If you exchange your item for a cheaper one, the delta will be refunded.
Article 11 - Legal warranties
The products sold are covered by the legal guarantee of conformity provided by articles L217-3 et seq. of the French Consumer Code and by the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code). These warranties cover both hidden and visible defects from the date of delivery. The only obligation incumbent on Dyades under this warranty is, at its option, the free replacement or repair of products recognized as defective, without any other service or compensation.
This warranty does not cover damage resulting from misuse, normal wear and tear or failure to follow maintenance instructions. In order to benefit from the product warranty, it is imperative to keep the product purchase invoice.

Article 13 - Data protection
The nominative data provided by the Customer is necessary for the processing of the order and the preparation of invoices.
They may be communicated to the seller's partners responsible for executing, processing, managing and paying for orders.
The purchaser has a permanent right of access, modification, rectification and opposition with regard to information concerning him or her. This right may be exercised under the terms and conditions defined in article 14.
Article 14 - Confidentiality
This privacy policy describes how your personal information is collected, used and shared when you visit or make a purchase from www.dyadesparis.com.
Collected data
The personal data collected on this site are as follows:
- account opening: when a user's account is created, the user's surname, first name and e-mail address.
- connection: when the user connects to the website, the latter records, in particular, his/her surname, first name, connection data, usage data, location data and payment data.
- profile: the use of the services provided on the website allows you to enter a profile, which may include an address and telephone number.
- payment: when paying for products and services offered on the website, the website records financial data relating to the user's bank account or credit card.
- communication: when the website is used to communicate with other members, data concerning the user's communications is stored temporarily.
- cookies: cookies are used for site use. Users can deactivate the various types of cookies (excluding technical cookies) using their browser settings.
Use of personal data
Personal data collected from users is used to provide and improve website services and to maintain a secure environment. More specifically, it is used for the following purposes:

- organization of the conditions of use of the Payment Services ;
